PRIVACY POLICY. INFORMATION ON DATA PROTECTION 

FINANZAUTO S.A.U. takes the protection of your personal data very seriously. For this reason, we inform you about the processing it is subject to, in a simple and transparent manner, so you can know your rights from the beginning and exercise them at any time. 

A) Personal data handler 

The personal data you have submitted to us will be processed by FINANZAUTO, S.A.U., with C.I.F.: A 28006922, and registered address in Arganda del Rey (Madrid), 28500, Avenida de Madrid, 43 (Spain).  

B) Storage of your personal data. International transfers 

The personal data you have submitted will be stored within the European Union, and occasionally it may be sent, transferred or processed or stored in a country not belonging to the EU or the European Economic Space, as long as this third-party receiving the data can guarantee that it will be protected adequately, in compliance with European Union regulations. In these cases, Finanzauto, S.A.U. will always sign contracts and legally binding documents with our supplier and third parties receiving the international transfer of data, wither with contractual legitimacy or with their consent, as well as documents for specific compliance by our provider and third parties, with European Regulations. 

These documents are directed exclusively to third parties that receive the personal data legitimately, (compliant, in any case, with the purposes referred to in this Privacy Policy) applying at least the same security standards implemented by Finanzauto, S.A.U. at any time, as well as the provisions of the European Regulation (EU) 2016/679, on the protection of natural persons concerning the processing of personal data and the free movement of such data. 

C) What do we use your personal data for and who we share it with. 

The data collected will be computer-processed under the responsibility of Finanzauto S.A.U., to carry out the sale of goods or provide services and be able to invoice them. The legitimacy for processing comes from the existence of a contractual or pre-contractual relationship for the sale of goods or to provide services.  

The principal purpose of the processing of your data consists of managing your purchase or request for products and services. In this respect, Finanzauto, S.A.U.:  

1. Will manage the products and services you request, in accordance with what was agreed. 

2. Will send you non-commercial notifications to manage your contractual relationship with Finanzauto, S.A.U. 

3. Will check with the manufacturers of the goods you have purchased or those used in the services you request, if you are eligible for any price discount or commercial attention that affects or could affect the obligations and rights agreed or being agreed. 

4. Will manage with the manufacturers, the guarantees for products and services you have purchased or requested. 

5. Will analyse and manage incidents or complaints related to the products and services you have purchased or requested. 

6. Will manage the different goods monitoring tools (machine, engines and technological equipment related to the machines or engines) when you have hired these monitoring tools. 

7. Will manage purchases and requests you carry out on the Finanzauto, S.A.U. Website. 

8. Will attend to your requests to purchase goods or requests for information on specific goods offered in the Finanzauto, S.A.U. Website, sending them, when appropriate, to the corresponding companies in the Tesya group that Finanzauto belongs to, in cases where your purchase or information requests refer to specific goods offered by these companies in the web pages mentioned above. 

Additionally, and only if you have consented on the form to the processing of your data, we will offer you personalised products and services, draws, loyalty activities related to these products and services, as well as send you quality questionnaires.  

1. Finanzauto, S.A.U. will keep you informed about new products and services (machines, engines and technological equipment related to the industry in which you and Finanzauto, S.A.U. work), discounts for the same, events related to these products and services, draws elated to these products and services, and anything that may interest you as a client of the public works machinery industry, construction, motors and equipment for generating energy, as well as the activities of Finanzauto, S.A.U. such as campaigns and promotions of interest to you, as you belong to the same industry as Finanzauto, S.A.U. 

2. Finanzauto, S.A.U. will communicate your data to companies belonging to the Group Finanzauto, S.A.U. is a part of, to offer you personalised products and services, always related to the public works machinery industry, construction, engines and energy-generating equipment. 

3. Finanzauto, S.A.U. may send you questionnaires on the quality of our services, or telephone you to analyse the quality of these services, either directly, or through third parties who, in any case, are obliged to use your data exclusively for these quality questionnaires for Finanzauto, S.A.U. 

The legal basis for this processing is the legitimate interest of Finanzauto, S.A.U. to inform you of the existence of personalised products and services, events, draws and loyalty promotion related to these products and services, sending quality questionnaires and your free and spontaneous consent, having been informed of this. 

Regarding data processing to access your private area on the Finanzauto, S.A.U. website after having registered on it.  

• Finanzauto, S.A.U. will use your personal data to access your private area to use your personal space, purchase goods or services on the website, request commercial or other information, or present claims, complaints or suggestions. 

The legal basis for processing your data to access the private area is to execute the goods sales or service contract; supply you with the information requested regarding the goods or services offered by Finanzauto or companies in the Tesya group on the web pages owned by Finanzauto; or to provide you with the possibility of presenting claims, complaints or suggestions. 

D) How does Finanzauto, S.A.U. obtain your personal data? 

Finanzauto, S.A.U. will obtain your personal data according to the purposes mentioned above, directly from you during: 

1. The process of purchasing products or services from Finanzauto, S.A.U.  

2. The process of registering in your private area on the Finanzauto, S.A.U. Website or the queries you send, after filling in the form at your disposal on the web pages and giving express consent for this processing. 

3. The consent you have given for processing your data, through the corresponding physical or electronic document. 

E) The time your personal data will be stored. 

FINANZAUTO, S.A.U., will process the information you send us to supply you with goods or services you have requested and to carry out the subsequent invoicing. The data submitted will be stored while the commercial relationship is maintained or for the time necessary to comply with legal obligations and attend to possible responsibilities derived from the purpose for which the data was collected.  

According to current fiscal and accounting regulations, we are obliged to keep the data for FIVE YEARS, which could be modified by changes in legislation. 

 Notwithstanding the above, your data could need to be stored for a longer period for reasons of legal defence in case of claims filed during the above-mentioned storage time. 

F) Who can access your personal data? 

The following will have access to your personal data: 

1. Finanzauto, S.A.U, for the purposes mentioned above, i.e.,  

• To manage purchases or requests for purchases of products and services. 

• To offer you personalised products and services, events, draws, loyalty activities related to these products and services, or to send you quality questionnaires. 

• To manage access to your private area on the Finanzauto, S.A. website after having registered on it. 

2. Companies in the group Finanzauto, S.A.U. belongs to, following what was said in the First Purpose. Section 8 and in the Second Purpose. Section 2., this is, respectively, that the companies in this group can offer you products and services you have requested information about , as they are provided on the website of Finanzauto, or to offer you, after you have given consent, personalized products or services, always related to the public works machinery industry, construction, engines and energy-generating equipment. 

            3. The manufacturers of the products you purchase, in accordance with the information, may determine if you are eligible for any discount or commercial attention that affects or could affect the obligations and rights agreed or which are being agreed with Finanzauto, S.A., or to manage the guarantees of products and services you have purchased or requested from Finanzauto, S.A.U. 

4. Third parties (including the manufacturers of the products you purchase), with the aim of:  

i. Carrying out, on behalf of Finanzauto, S.A.U. , questionnaires or quality assessments regarding the products sold or services provided, always after having received your consent. 

ii. Carrying out, on behalf of Finanzauto, S.A.U., activities of judicial and extrajudicial activities to collect debts (an activity known as "debt collection"). 

5. Authorities and public institutions, when Finanzauto, S.A.U. is legally obliged to supply the data. 

6. Financial institutions, when necessary to carry out the pre-contractual or contractual management of the products or services offered by Finanzauto that are going to be purchased with finance and Finanzauto is requested to collaborate with these entities for said finance. 

G) What are your rights over the personal data you have submitted? 

You have the right to obtain information about the processing of your data by FINANZAUTO, S.A.U., having rights to access, correct, delete and request portability of the data, as well as limit or oppose its processing by Finanzauto, S.A.U., with address at Arganda del Rey (Madrid), Avenida de Madrid 43, C.P 28500, or by e-mail: ejercitatusderechoslopd@finanzauto.es, attaching a copy of your DNI or equivalent ID document.  

The following is a brief explanation of each of these rights: 

- Right to access: This right entitles you to know if we are processing your data and if so, to receive information about what data is processed. 

- Right of correction: This right entitles you to modify and correct inexact data, once you have exercised your right to access. 

- Right to delete: This right entitles you to request the deletion of data that is inadequate or excessive for the use it is destined to. 

- Right to oppose: This right entitles you to refuse the processing of your data or stop processing it. 

- Right of Portability: Entitles you to receive a copy of your data in a structured form to proceed to transmit it to another data handler of your choice. 

- Right of limitation: This entitles you to request the restriction of your data if it is illicit, unnecessary or excessive, and you have opposed it.  

 Moreover, and especially if you consider that you have not obtained full satisfaction in the exercising of your rights, you may present a complaint before the national control authority: The Spanish Data Protection Agency, C/ Jorge Juan, 6 – 28001 Madrid (Spain). 

Likewise, regarding direct and e-mail marketing, in compliance with the provisions of Article 21 of Law 34/2002, on Information Society and E-commerce Services, you are entitled to oppose the reception of commercial e-mail communications, through a free and straightforward procedure that will be included in each message you receive. H) How do we ensure the protection of your data? 

In FINANZAUTO, S.A.U., we process your data in an absolutely confidential manner, maintaining the duty of secrecy. We also adopt the technical and organisational measures necessary to guarantee the security of the data, reinforcing the general security of the processing in the case of personal data, systems, communications environment and corporate organisation, as well as to guarantee protection against unauthorized or illicit handling and against its loss, destruction or incidental damage (principle of integrity and confidentiality). 

Finanzauto, S.A.U., will look after your data and maintain continuous supervision, control, security and evaluation of your processes to ensure respect for your privacy and protection of the information. 

For these purposes, we will take particular care with the application criteria, security measures and other obligations associated with the GDPR, with special attention to the provisions of Article 32. 

I) Modification of the privacy policy 

Finanzauto, S.A. may modify its Privacy Policy in compliance with modifications in legislation. You will be informed of any change in the Privacy Policy that affects the processing of your personal data.
